Landlord - Tenant Disputes
With the constant changes in the law around residential tenancies, both Landlords and Tenants alike can feel overwhelmed as to their rights, obligations and constraints. Here at Lawson West Solicitors, we have specialist Solicitors who are able to understand and advise on both roles.
Possession Disputes
With the varying rules surrounding possession during the pandemic, Landlords may find it easier to instruct solicitors to draft the relevant notices for possession. Regardless of whether you would like to give the Tenant notice on the basis that you would like to occupy the property or because they are in rental arrears, we can help you by:
-
Contacting the Tenants regarding late or withheld rent payments
-
Drafting and serving the relevant notices for possession
-
Assisting tenants in the defence of possession proceedings and making claims for illegal eviction
-
Issuing a claim for possession if the Tenants refuse to vacate the Property
-
Drafting and filing any supporting witness statements
-
Arranging advocates to represent you should your matter proceed to court
-
Arranging bailiffs to attend the property further to enforce a Court Order
-
Advising Landlords on any disputes surrounding residential tenancies including flats, apartment blocks and HMOs
-
Defending mortgage repossession claims
-
Preparing your claim for disrepair.
Alternatively, if you are a Tenant who wishes for us to act on your behalf, we can respond to all necessary correspondence on your behalf and look to take action against Landlords for their breaches.
Deposit/Breach of Contract
When a Tenant begins living in a property it is standard practice for them to sign a tenancy agreement. The Landlords are then required to provide the Tenant with various documents to ensure their compliance with the regulations. Within the tenancy agreement, there will be set terms for both parties to abide by throughout the tenancy period.
If either party has committed a breach of the tenancy, we can help you with:
-
Engaging in pre-action correspondence with either your Landlord or Tenant
-
Drafting and serving the appropriate n upon the Landlord or checking the accuracy and validity of a notice served on you as a Tenant
-
Assisting with recovering a protected deposit for both parties
-
Advising Landlords and Tenants on their obligations relating to repairs and dilapidations
-
Issuing the necessary claim to seek the appropriate remedy for you
-
Arranging advocates to represent you should your matter proceed to court.
