Family Law: Adoption

A case taken to the High Court has ruled in favour of a mother who wanted to prevent her parents bringing up her children after she gave them up for adoption. She did not even want them to know she had given birth to twins and this ruling means they never will.

The mother felt so strongly that she refused to provide contact details for any members of her family when promoted to by social workers. She did relent and provided details for the children’s biological father however he initially denied they were his until a DNA test proved that they were.

He then refused to look after them on the grounds he would not be able to support them.

The Judge ruled that the human rights of the mother would be breached if her parents were to even be informed of the children’s birth. He was satisfied she had “legitimate reasons for not wishing to care for the twins.”

Head of the Lawson-West Family Law department, Alistair Dobson, comments: “Adoption ends the legal relationship between a childand it’s birth parents and establishes a new relationship with adoptive parents.

Adoption agencies arrange adoptions which are then made legally binding by the courts. Once the Judge grants an Adoption Order it is final and cannot be undone.
