In a potential redundancy situation you must remember:
- That genuine redundancy is when an employer no longer requires a role/roles to be carried out, where there is a reduction in the number of staff needed to fill a role/roles or when a business is closing.
- Redundancy is not about the performance of an individual or any other failings of that individual (although this may be relevant in the selection criteria).
- TUPE is not redundancy.
- Ensure that you plan thoroughly and schedule what actions you need to take and when.
- Remember collective consultation meetings (if applicable) and individual consultation meetings.
- Make sure that the pool of employees and the selection criteria is fair and reasonable.
- The selection criteria used should always discount any absences caused by disability or pregnancy.
- Any vacancies available should be offered to those at risk of redundancy.
- Always communicate with those employees who are staying and not effected by the redundancy.
