Can I include my pets in my Will?

After reading my Family law colleague Matt Harcourt-Poole’s interesting article [If I divorce you – who gets the dog?] which was written following publication of the 2024 PDSA Animal Wellbeing (PAW) report, it made me think about how we can protect our pets in our Wills. 

For many of us, our pets are more than just animals, they are family members and they hold a special place in our hearts.  But what happens to these beloved companions if we’re no longer here to care for them?

Including Pets in Your Will

Whilst pets cannot inherit money or property themselves, you can make provisions in your will to ensure they are well looked after. This might include:

  • Naming a caregiver: You can appoint someone you trust to take care of your pet.  This can be an individual or, if there is nobody suitable, you can nominate a charity to take care of or rehome your pet.

  • Leaving a cash legacy for their care: Set aside a specific sum to cover your pet’s needs, such as food, grooming, and veterinary bills.

  • Writing a letter of wishes: this can be used to leave guidance to the named caregiver about how to care for your pet.

  • Creating a Trust: this is less common but there are methods of creating a trust in your Will to maintain or benefit your pet after you have died. 

It’s also a good idea to discuss your wishes with the person you intend to appoint as your pet’s caregiver.  While it’s not legally binding for someone to take on this responsibility, having their agreement in advance ensures your plans can be carried out smoothly.
