Planning a Funeral...

Whose responsibility is organising a funeral and what steps do they have to take?

The responsibility for organising a funeral usually falls to the executor named in the deceased's Will. If there's no Will, a close family member or next of kin generally steps in. If no one is available, the local council may arrange a simple service under the Public Health Act.

When appointing a professional executor to administer your Will it will be their responsibility to organise your funeral (in accordance with any instructions left behind) and this is a duty that we at Lawson West take very seriously.  If we are appointed to act as executor in a Will we endeavour to ensure that the funeral reflects the life and beliefs of the deceased and take into account the wishes of any surviving family or friends.

Key Steps to Organising a Funeral:

  1. Contact a Funeral Director:

They assist with arrangements like transporting the body, planning the service, and handling cremation or burial.  At Lawson West we have used the services of a wide range of funeral directors in Leicestershire, Northamptonshire and further afield.

  2. Register the Death:

This must be done at the local Registrar’s Office. A Death Certificate is required before proceeding with funeral arrangements.

  3. Decide on Burial or Cremation:

The deceased's wishes, if known, should guide this. If not, the decision rests with the family or organiser.

  4. Plan the Service:

This includes selecting a venue, music, readings, flowers, and arranging transportation for mourners.  It can also include arranging for a wake to take place.

  5. Covering Costs:

Funeral costs are usually paid from the deceased’s estate and most banks will release funds directly for this. If the estate can't cover costs, family or local council support may be needed.

If you're unable to afford funeral costs, government support is available through the Funeral Expenses Payment for eligible individuals.

The Probate, Wills and Trusts team at Lawson West Solicitors are here to support you at all stages and are happy to discuss funeral arrangements either during the Will making process or following the sad passing of a loved one. Please contact us if we can assist in any way.
